Terms of Service

Effective Date: October 26, 2023

Agreement to Terms

Welcome to PixeledHost! These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and PixeledHost (“we,” “us,” or “our”), concerning your access to and use of our game server hosting services (the "Services"). By purchasing or using our Services, you acknowledge that you have read, understood, and agree to be bound by all of these Terms.

Account & Responsibilities

You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all content posted and activity that occurs under your account. You must be a human. Accounts registered by “bots” or other automated methods are not permitted.

Payments & Refunds

A valid payment method is required for all services. Services are billed on a recurring basis (e.g., monthly, quarterly). You agree to pay for the services in advance of the time period during which such services are provided. Failure to pay may result in suspension or termination of your service.

Our refund policy is as follows:

  • A refund can be requested within forty-eight (48) hours of the initial purchase date for a new hosting service.
  • Service upgrades, downgrades, software licenses, and addons are not eligible for refunds.
  • Accidental duplicate payments for the same service may be refunded at our sole discretion after a review.

Chargebacks & Disputes

Initiating a chargeback or payment dispute with your financial provider is a violation of these Terms. If you have a billing concern, you agree to contact our support team first to resolve the issue. Should a chargeback be initiated, we reserve the right to immediately suspend all associated services, collect any outstanding balance, and report the incident to chargeback abatement services. Such actions may negatively impact your ability to use services from other providers.

Acceptable Use

You agree not to use the Services for any illegal or unauthorized purpose. Prohibited activities include, but are not limited to:

  • Hosting or distributing malicious software (malware, viruses, etc.).
  • Engaging in denial-of-service (DDoS).
  • Hosting phishing sites or engaging in fraudulent activities.
  • Hosting or storage of pornographic material or other lewd media
  • Distributing/Encouraging hate speech or any content that is abusive.
  • Cryptocurrency mining or similar high-CPU, non-game related tasks.
  • Distributing copyrighted material without permission.

Violation of this policy may result in immediate suspension or termination of your Services without a refund.

Data Loss & Backups

We are committed to helping you protect your data. As a courtesy to our clients, we perform automated offsite backups for all game servers twice daily. These system-level backups are retained for a period of three (3) days and are intended for disaster recovery purposes.

Additionally, your service includes access to the Pterodactyl control panel’s built-in backup system. You can create and restore your own backups at any time, subject to the storage limits defined by your specific hosting plan. This gives you direct control over your data.

Despite these measures, you acknowledge that the ultimate responsibility for maintaining and securing your critical data lies with you. We strongly encourage you to make and store your own regular backups. PixeledHost is not liable for any data loss or data corruption.

Scope of Support

We pride ourselves on offering comprehensive support to help you get the most out of your service. Our team is here to assist with all aspects of our hosting platform, including hardware, network, and control panel functionality. We also strive to provide robust support for many popular third-party game modifications, plugins, and configurations.

Please understand that while we go above and beyond to help, our support has reasonable boundaries. We do not write or debug custom code for clients. Furthermore, some issues may be beyond our control due to factors like:

  • Bugs or flaws within the third-party software (mods, plugins) itself.
  • Fundamental incompatibilities between different mods or game versions.
  • Highly obscure or experimental software that we may not have knowledge of.
  • Premium or paid third-party software to which we do not own a license. We cannot configure or troubleshoot software that we cannot legally and ethically access ourselves.

In these cases, we will always offer our best-effort advice and attempt to point you in the right direction, but we cannot guarantee a direct solution. Our primary goal is to be a partner in your success, and we will always be transparent about what we can and cannot support.

"Unmetered" Fair Use Policy

Our "Unmetered" plans are designed to provide you with the resources needed to run a thriving game server without worrying about typical usage spikes. This policy exists to ensure a stable, high-performance environment for all customers.

Permitted Usage: Fair use explicitly includes all standard and intensive operations related to managing your game server. This covers your game worlds, player data, mods, and plugins. Intensive but temporary tasks, such as pre-generating a large Minecraft world or uploading a large map file, are perfectly acceptable and encouraged for a smooth player experience.

Usage Not Covered: This policy does not cover activities unrelated to game server operation. This includes using your service as a general file-hosting platform, a personal cloud backup for non-game files, a video streaming service, or for data archiving. These activities place a sustained, non-typical load on our infrastructure.

Our Commitment: If we detect resource usage that falls outside these guidelines and negatively impacts the server node for other users, our first step will always be to contact you to discuss the situation and find a friendly solution. We only reserve the right to suspend services in extreme cases or where a collaborative solution cannot be reached, in order to protect the performance and integrity of our network for everyone.

Disclaimer of Warranties

The Services are provided on an "as-is" and "as-available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the services will meet your requirements, be uninterrupted, timely, secure, or error-free.

Indemnification & Refusal of Service

You agree to indemnify and hold harmless PixeledHost and its owner from any and all claims, liabilities, losses, damages, and expenses, including reasonable attorney fees, arising out of your use of the Services or your violation of these Terms. We reserve the right to refuse service to anyone for any reason at any time.

Termination

You may cancel your service at any time via our client billing area. We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Service for any reason, particularly for violation of these Terms, at any time without notice.

Modification of Terms

We reserve the right, at our sole discretion, to change or modify these Terms at any time. We will post the revised terms on this page and update the "Effective Date" at the top. It is your responsibility to review these Terms periodically for changes. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
